These delays impeded SkyCity's ability to transfer control of the parking facility as per their contract, leading Macquarie to withdraw from the agreement. The withdrawal triggered a contentious payment clause, bringing to light differing valuations of the concession by accounting firms Deloitte and KPMG, representing SkyCity and Macquarie, respectively.
SkyCity's recent legal victory comes as the High Court of New Zealand favoured its interpretation of the contract terms. Although SkyCity is still required to compensate Macquarie for not fulfilling the contract, the decision means a substantial financial saving for the casino operator. However, the possibility of an appeal by Macquarie remains, potentially prolonging the legal tussle.
In addition to this dispute, SkyCity faces other significant challenges. The Department of Internal Affairs in New Zealand has called for a temporary shutdown of the company's three casinos. Additionally, in Australia, the Adelaide property of SkyCity is under scrutiny by the Transaction Reports and Analysis Centre (AUSTRAC) for potential anti-money laundering regulation breaches, which could cost the company a hefty sum.
The matter of financial responsibility for the fire's damages continues to be unresolved. Fletcher Building, the primary contractor, has received some insurance compensation but is seeking further recompense.
On October 22, 2019, a catastrophic fire engulfed the SkyCity Convention Centre in Auckland. Originating during the construction's final phase, the fire caused extensive damage and city-wide disruptions. Initially valued at NZ$703 million, the project's cost has now escalated to over NZ$1 billion. The fire, which lasted several days, was eventually attributed to an accidental ignition of roofing material by a blow torch. Remarkably, there were no casualties reported.
